NOTICE is hereby given that on April 27, 2021, and amended on May 17, 2021, May 24, 2021 and May 25, 2021, Restoration Group, Inc., c/o Harvey Diamond, P.O Box 27333, Albuquerque, New Mexico 87125, filed Application No. G-03218 with the STATE ENGINEER for a Permit to Add an Additional Groundwater Point of Diversion within the Gallup Underground Water Basin within the State of New Mexico.

Catron County is the New Mexico County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the El Defensor Chieftain.

The applicant proposes to commence using supplemental well G-03218 POD3, completed to a depth of 300 feet, with up to a 15-inch casing, on land owned by Jay Houston and leased by Restoration Group, Inc., located at a point described as where 34° 08′ 28.0? North Latitude and 108° 49′ 19.0? West Longitude intersect, WGS84, further described as located within the SE¼SE¼ of Section 9, Township 2 South, Range 19 West, NMPM, within Catron County, New Mexico, to supplement one existing well, being G-03218 POD1, located at a point described as where
34° 08′ 44.3? North Latitude and 108° 49′ 21.1? West Longitude intersect, WGS84, further described as located within the SW¼NE¼ SE¼ of Section 9, Township 2 South, Range 19 West, NMPM, on land owned by Jay Houston and leased by Restoration Group, Inc., for the total permitted diversion of 110 acre-feet per annum (afa), for a commercial purpose of use (bulk water sale for construction) within the place of use, being within Catron County, New Mexico. The points of diversion are generally located west of Hardcastle Gap Road and east of Bill Knight Gap Road, Catron County, New Mexico.

This application is made to supplement well G-03218 POD1 which has reduced capacity. No new appropriation of water is requested by this application. The applicant requested and has been granted an Emergency Authorization to drill and commence use of the supplemental well under Section 72-12-24, NMSA, 1978, stating that an emergency situation exists in which the delay caused by publication and hearing would result in serious economic loss due to the lack of water. Said Emergency Authorization was granted for the combined diversion of water from all wells not to exceed a maximum of 110 afa, for a commercial purpose of use (bulk water sale for construction) within the place of use, being within Catron County, New Mexico.

Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, District 1 Office, 5550 San Antonio Drive NE, Albuquerque, NM 87109, by August 20, 2021. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be

used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, District 1 Office, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
