NOTICE is hereby given that on October 21 2020, The Village of Magdalena, 108 N. Main Rd, Magdalena, NM 87825, filed with the STATE ENGINEER Application No. RG-46840 POD2 for Permit for an Additional Groundwater Point of Diversion within the Rio Grande Underground Basin of the State of New Mexico.
Socorro County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the El Defensor Chieftain.
The applicant proposes to supplement existing well RG-46840 POD1 located at Latitude 34°7’53.14″N and Longitude 107°12’32.46″W in the SW¼ SE¼ of Section 13, Township 2 South, Range 4 West, NMPM, on land owned by S.E. & Lucille Gutierrez, with the drilling and use of supplemental well RG-46840 POD2 with proposed location at approximately Latitude 34°7’49.96″N and Longitude 107°12’32.36″W in the SW¼ SE¼ of Section 13, Township 2 South, Range 4 West, NMPM, on land owned by Patrick Trujillo, for the continued diversion of 2,522 acre-feet per annum for municipal purposes within the service area of the Village of Magdalena described as 421 acres of land being within the SE¼SW¼, SW¼SE¼ and SE¼SE¼ of Section 13, SW¼SW¼, SE¼SW¼, SW¼SE¼, SE¼SE¼, NE¼SW¼, NW¼SE¼ and NE¼SE¼ of Section 22, SW¼SW¼, NW¼SW¼ and SW¼NE¼ of Section 23, Lot 6 and Lot 7 of Section 24, NW¼SW¼, SW¼NW¼ and NW¼NW¼ of Section 26, NE¼NW¼, NW¼NE¼, NE¼NE¼, SE¼NE¼, SW¼NE¼, SW¼NW¼, NW¼NW¼, NW¼SE¼, NE¼SW¼, NE¼SE¼ and SE¼SE¼ of Section 27, and NE¼NE¼ of Section 28, all within Township 2 South, Range 4 West, NMPM, in Socorro County, New Mexico. The wells are approximately located 0.59 miles east of the Village of Magdalena municipal boundaries on Highway 60 in Socorro County, New Mexico.
No new appropriations are requested under this application.

Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Dr NE, Albuquerque, NM 87109, on or before February 26, 2021. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 505-383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
