NOTICE is hereby given that on March 15, 2022, applicant Dick Wellborn, c/o Wacey Walraven, HC 62 Box 607, Datil, NM 87821, filed Application No. RG-37747 with the STATE ENGINEER for permit to Change Place of Use of Groundwater in the Rio Grande Water Basin of the State of New Mexico.
Catron is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the El Defensor Chieftain.
The applicant proposes to change the place of use of diversion of 316.66 acre-feet per annum (afa) of groundwater, from well no. RG-37747-POD1, located at a point where latitude = 34° 00′ 57.92″ N and longitude = 107° 58′ 00.26″ W, in the NW¼ NW¼ SE¼ of Section 27, Township 3 South, Range 11 West, NMPM, currently used for the irrigation of 158.33 ac. of land described as being within the S½ NE¼ and the N½ SE¼ of Section 27, Township 3 South, Range 11 West, NMPM. The applicant further proposes to irrigate 158.33 ac. described as being within the W½ NW¼ (32.35 ac.) and NW¼ (7.06 ac.) of Section 26 and within the NE¼ (90.42 ac.) and N½ SE¼ (28.50 ac.) of Section 27, Township 3 South, Range 11 West, NMPM. The well, move-from place of use, and move-to place of use are all on land owned by Dick Wellborn and are located approximately 1 mile southeast of Hwy 12 and 11 miles southwest of the Town of Datil, Catron County.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment, if impairment you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM, 87109, on or before June 24, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
