NOTICE is hereby given that on April 1, 2022, Eddie B. and Maria J. Corley, 13605 Pino Ridge Pl. NE, Albuquerque, New Mexico 87111, filed Application No. RG-71296 POD2 for a Permit to Change Groundwater Point of Diversion with the STATE ENGINEER in the Rio Grande Underground Water Basin in the State of New Mexico.

Socorro is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the El Defensor Chieftain.

The applicant proposes to commence the use of well RG-71296 POD2, which was drilled without benefit of permit, to a depth of 155 feet, with a casing diameter of 12 inches, located at a point where latitude 33° 55′ 46.0″ North and longitude 106° 50′ 02.2″ West intersect, on land owned by the applicant, to be a replacement well within 100 feet of existing permitted well RG-71296 POD1, located at a point where latitude 33° 55′ 46.05″ North and longitude 106° 50′ 01.66″ West intersect, which is failing. The replacement well is to be the point of diversion for leased water from the MRGCD Water Bank, under OSE Permit No. SD-0620 and SP-1690 into RG-71296 for the diversion of up to 88.587 acre-feet per annum, for irrigation purposes on 29.529 acres of land described as within Tracts 13, 14, and 15 on MRGCD Map 171. The well and place of use are generally located 1 mile north of the intersection of Bosquecito Rd and Highway 380, San Antonio, Socorro County, New Mexico. The replacement well was mistakenly drilled under a repair and deepen permit for RG-71296-A POD1 and is currently capped and will not be used until the Applicant and MRGCD enter into a lease agreement for Water Bank water. No new appropriation of water above the applicants’ lease right is requested by this Application.

Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, by August 10, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
