NOTICE is hereby given that on April 20, 2021, Travis Harris, PO Box 184, San Antonio, NM 87832, Agent: WaterBank 610 Gold Avenue SW, Suite 111, Albuquerque, New Mexico, 87102 and the Chacon Family Trust, 119 4th SW, Albuquerque, NM 87105, filed Application No. SD-09707 with the STATE ENGINEER for Permit to Change the Point of Diversion and Place of Use of Surface Water within the Rio Grande Basin, in the State of New Mexico, under NMAC 19.26.2.11.
Socorro County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the El Defensor Chieftain.
The applicants propose to discontinue the diversion and use of a farm delivery requirement (FDR) of 20.79 acre-feet per annum of surface water, inclusive of a consumptive irrigation requirement (CIR) of 14.55 acre-feet per annum, from the San Juan Acequia, with a point of diversion on the Rio Grande at the Isleta Diversion Dam (SP-1690-3), on land owned by Pueblo of Isleta, at a point where X = 346,037 meters & Y = 3,863,880 meters, Zone 13, UTM (NAD83) for the irrigation of 6.93 acres of land. The move-from land is described as Tract 21A (1.47 acres), Tract 21B (2.0 acres), Tract 21C2A (2.72 acres), and Tract 21E (0.74 acres), MRGCD Map 122, owned by Martin T. Black, located within Section 7, Township 3 North, Range 2 East, NMPM. These move-from lands are generally located 0.4 miles southwest of the intersection of NM Highway 304 and Ranchitos Rd., Veguita, Socorro County, New Mexico.
The applicants further propose to transfer said water right and commence diversion from the Socorro Main Canal with a point of diversion on the Rio Grande at the San Acacia Diversion Dam (SP-1690-4), on land owned by MRGCD, at a point where X = 326,225 meters & Y = 3,792,219 meters, Zone 13, UTM (NAD83), in addition to supplemental well RG-93232 POD2, located at a point where X = 328,056 meters & Y = 3,752,843 meters, Zone 13, UTM (NAD83), which is a permitted, alternate point of diversion when there is a shortage of surface water, for the irrigation of 6.93 acres of land described as the southeast portion of Tract 6A1 and the middle portion of Tract 60, located on MRGCD Map 175, within Section 5, Township 5 South, Range 1 East, NMPM, owned by Dennis Harris with a lease to Travis Harris. This move-to land is generally located 0.51 mile east of the intersection of State Road 1 and 11th Street, San Antonio, Socorro County, New Mexico.

Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). The objection to the approval of the application must be based on: (1) Detriment; if detriment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM 87109, on or before July 23, 2021. Facsimiles (faxes) will be accepted as a
valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 505-383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
