NOTICE is hereby given that on January 19, 2022, Jerome Cordova, 02 Thomas Lane, Bosque, NM 87006, and Kyle Duggins, 522 NM Highway 408, Lemitar, NM 87823, filed with the STATE ENGINEER Application No. SD-10017 into SP-5190 for Permit to Change Place of Use and Point of Diversion of Surface Water of the Rio Grande within the State of New Mexico.

Further, on February 4, 2022, Jerome Cordova, 02 Thomas Lane, Bosque, NM 87006, and Cordova Living Trust, c/o: Toby and Mary Ann Cordova, 1100 Parkview Dr., Los Lunas, NM 87031, filed with the STATE ENGINEER Application No. SD-09361 into SP-5190 for Permit to Change Place of Use of Surface Water of the Rio Grande within the State of New Mexico.

Valencia County and Socorro County are the Counties affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in The Valencia County News and El Defensor Chieftan.

Kyle Duggins proposes to discontinue the Farm Delivery Requirement (FDR) of 22.533 acre-feet per annum (afa) of surface water, inclusive of a Consumptive Irrigation Requirement (CIR) of 15.7731 afa from the Lemitar Lateral, with a point of diversion on the Rio Grande at the San Acacia Diversion (SP-1690-4), on land owned by the Middle Rio Grande Conservancy District (MRGCD), at a point where X=326,225 meters and Y=3,792,219 meters, UTM Zone 13N, NAD1983, for irrigation of its current place of use on land described as 7.511 acres Parcel B of MRGCD Map 153, within Section 1, Township 2 South, Range 1 West, NMPM owned by Kyle Duggins. Specifically, 3.270 acres in the northeast corner and 4.241 acres in the middle of the aforementioned parcel. The move from place use is in Lemitar, in Socorro County.

Further, the Cordova Living Trust proposes to discontinue the FDR of 6.0417 afa of surface water, inclusive of a CIR 4.2291 afa from the La Constancia with a point of diversion on the Rio Grande at the Isleta Diversion Dam (SP-1690-3), on land owned by Pueblo of Isleta, at a point where X=346,037 meters and Y=3,863,880 meters, UTM Zone 13N, NAD1983, from its current place of use on land described as 2.0139 acres of Tract A4A, MRGCD Map 85, within Section 15, Township 6 North, Rage 2 East, NMPM owned by Cordova Living Trust. The move from place of use is in Los Chaves, in Valencia County.

Further, Jerome Cordova proposes to transfer both above described move from water rights for a combined FDR of 28.5747 afa of surface water, inclusive of a CIR of 20.0022 afa to the Feeder #3, with a point of diversion on the Rio Grande at the Isleta Diversion Dam (SP-1690-3), on land owned by Pueblo of Isleta, at a point where X=346,037 meters and Y=3,863,880 meters, UTM Zone 13N, NAD1983, to a new place of use described as 9.5249 acres of Tracts 91A1, 91D, 91E, 91F, 91G1B, 98, 86B, 85A2B, and 0.0589 acres of Tract 92B2 on MRGCD Map 112, within Section 18, Township 4 North, Range 2 East, N.M.P.M owned by Jerome Cordova. The move to place of use in Bosque, in Valencia County. No additional water is sought by this application nor a change of surface water to groundwater.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Detriment; if detriment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM 87109-4127, on or before May 6, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 505-383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
