NOTICE is hereby given that on December 22, 2021, and amended on March 29, 2022, David Douglas & Cathy L. Figgs, PO Box 3, Lemitar, NM 87823, filed with the STATE ENGINEER Application No. RG-00167 POD 3 for Permit to Change Partial Point of Diversion of Groundwater within the Middle Rio Grande basin of the State of New Mexico. An affidavit requesting Emergency Authorization was requested and granted.
Socorro County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the El Defensor Chieftan.
The applicants propose to discontinue the use of the well numbered RG-00167, located at latitude 34o 8′ 55.65″ North and longitude 106o 53′ 31.67″ West. RG-00167 is on land owned by Casey & Cindi Cordova described as Tract 102, MRGCD Map 154, in Section 12, Township 2 S Range 1 W, NMPM. The applicant will continue diversion of ground water from proposed supplemental well RG-00167 POD 3, which will be located at latitude 34o 8′ 45.29″ North and longitude 106o 53′ 31.92″ West. This proposed well will be drilled to a depth of approximately 100 feet, and will have a casing size of 12 inches. The total amount of water diverted from RG-00167 POD 3 will not exceed a farm delivery requirement of 26.382 acre-feet per annum, inclusive of a consumptive use amount of 18.4674 acre-feet per annum, for irrigation purposes. The place of use is 8.794 acres of land owned by David Douglas & Cathy L. Figgs, described as Tract 94C (6.054 acres) and Tract 103 (2.740 acres), both found in MRGCD Map 154. The place of use and proposed supplemental well are located in Section 12 of Township 2 S, Range 1 W, NMPM. The place of use and proposed supplemental well are generally located approximately 1.75 miles southeast of exit 156 from I-25 in Lemitar, New Mexico.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM 87109, on or before Friday, June 10, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 505-383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
