NOTICE is hereby given that on August 24, 2020, Goldenseed, LLC, a NM limited liability company, c/o Lynn Ambrosino, 933 San Mateo, NE Su. 500 #314, Albuquerque, NM 87108, and co-applicants Joseph Lee and Deanna M. Mackey, 617 Vista Abajo Dr. NE, Albuquerque, NM 87123, filed Application No. SD-02826-F into RG-95856 with the STATE ENGINEER for a Permit to Change Place, Purpose of Use and Point of Diversion from Surface Water to Groundwater within the Rio Grande Basin, in the State of New Mexico. Socorro is the only county affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the El Defensor Chieftain. The applicants propose to discontinue the farm delivery requirement of 9.939 acre-feet of surface water per annum (AFA), inclusive of a consumptive irrigation requirement of 6.9573 AFA from the Belen Grant Lateral #1, with a point of diversion on the Rio Grande at the Isleta Diversion Dam located at a point where X=346,037 meters, Y=3,863,880 meters, UTM Zone 13N, NAD83, on land owned by the Pueblo of Isleta, for the irrigation of 3.130 acres of land owned by William D. Bjorling, described as Tract 16A3, Lands of Leo & Vina Mendoza, MRGCD Map 127, Socorro County, New Mexico. The move-from lands are generally located east of I-25 approximately 0.6 miles west from the intersection between Cam Ulibarri and NM-304 N, Socorro County, New Mexico. The applicants propose to transfer the above described 6.9573 acre-feet of consumptive use water rights to existing well RG-95856 located at a point where X=334,702.65 meters and Y=3,819,592.47 meters; UTM, NAD83, Zone 13N, for commercial greenhouse and drip irrigation purposes, within16 acres of land owned by Thomas M. and Sylvia M. Meketi, further described as Claim of Exemption Plat of Lands of Yolanda Chavez Downey and David and June Stange, Tract 120E-1 (2.9519 acres) and Tract 119B-1-A-1-A (13.0481 acres), MRGCD Maps 121 & 122, Socorro County, New Mexico. The move-to lands and well are located east of Interstate 25 and 9.4 miles south on NM-116 from intersection of S. Main St and State Hwy 116S in Veguita, Socorro County, New Mexico. The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Dr NE, Albuquerque, NM 87109, by November 30, 2020. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, 505-383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
