Socorro County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the El Defensor Chieftain (Socorro County).

The co-applicants propose to temporarily discontinue (for a period of five years and nine months, commencing April 1, 2021 and ending December 31, 2026), the diversion of 16.02 acre-feet per annum (afa) Farm Delivery Requirement (FDR) of Surface Water, inclusive of a Consumptive Use (CIR) of 11.214 afa, for the irrigation of 5.34 acres of land owned by Phillip N. Alexander and Wanda E. Alexander, Trustees of The Phillip Nelson Alexander and Wanda Erlene Alexander Revocable Trust, described as Pt. of Tract 84 (0.323 ac.), Tract 83B (1.162ac.) and the East Pt. of Tract 85B1B (3.855ac.), all located on MRGCD Map No. 147, within Socorro County, within Section 2, Township 1 South, Range 1 West, NMPM, from the Alamillo Acequia, with a point of diversion on the Rio Grande at the San Acacia Diversion Works (SP-1690-4), on land owned by the Middle Rio Grande Conservancy District (MRGCD), located within the Sevilleta Grant, within projected SW¼ NE¼ NE¼ of Section 1, Township 1 South, Range 1 West, NMPM, at a point where X=326,225 meters and Y=3,792,219 meters intersect, UTM Zone 13N, NAD 1983. The Move-from tracts are all located on the south side of San Acacia Road, east of the Alamillo Acequia, Alamillo, Socorro County, New Mexico. The subject Surface Water rights under File No. SD-09665 and appurtenant to the Move-from land were reserved separately and are owned by LL Land & Cattle, LLC., a NM Limited Liability Company.

The co-applicants further propose to transfer 16.02 afa FDR of Surface Water, inclusive of a CIR of 11.214 afa, for the irrigation of 5.34 acres of land owned by Phillip N. Alexander and Wanda E. Alexander, Trustees of The Phillip Nelson Alexander and Wanda Erlene Alexander Revocable Trust, described as Plat of Survey of Tract B, Division Plat of Lands of Willburn H. Lynch, the NW Pt. of Tract One (3.57 acres) and the SW Pt. of Tract One (1.77 acres) located on MRGCD Map No. 147, within Socorro County, within Section 2, Township 1 South, Range 1 West, NMPM, from the Alamillo Acequia, with the same point of diversion on the Rio Grande being the San Acacia Diversion Works (SP-1690-4). The Move-to tracts are located on the north side of San Acacia Road, east of the Alamillo Acequia, Alamillo, Socorro County, New Mexico. The Surface Water rights appurtenant to the subject Move-to lands were previously severed under Permit No. SD-08868 into RG-10260 & RG-82157, approved by the State Engineer on December 23, 2011.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless the Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Detriment; if detriment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the State of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, District 1 Office, located at 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, on or before July 9, 2021. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
