NOTICE is hereby given that on November 12, 2021, Adrienne Hubbard, 3501 Mary Ellen Ct., NE, Albuquerque, NM 87111, filed with the STATE ENGINEER Application No. SD-09665-B into RG-52837, for a Permit to Change Point of Diversion from Surface Water to Ground Water within the Rio Grande Underground Water Basin, of the State of New Mexico.

Socorro County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the El Defensor Chieftain.

The applicant proposes to discontinue the diversion of 0.75 acre-feet per annum (afa) Farm Delivery Requirement (FDR) of Surface Water, inclusive of a Consumptive Use (CIR) of 0.525 afa, for the irrigation of 0.25 acre of land owned by Phillip N. Alexander and Wanda E. Alexander, Trustees of The Phillip Nelson Alexander and Wanda Erlene Alexander Revocable Trust, described as the West Pt. of Tract 85B1B on MRGCD Map No. 147, in Section 2, Township 1 South, Range 1 West, NMPM, from the Alamillo Acequia, with a point of diversion on the Rio Grande at the San Acacia Diversion Works (SP-1690-4), on land owned by the Middle Rio Grande Conservancy District (MRGCD), located in the Sevilleta Grant, in projected SW¼ NE¼ NE¼ of Section 1, Township 1 South, Range 1 West, NMPM, at a point where X=326,225 meters and Y=3,792,219 meters intersect, UTM (NAD 83) Zn 13N. The move-from tract is located on the south side of San Acacia Road, east of the Alamillo Acequia, Alamillo, Socorro County, New Mexico. The subject Surface Water rights under File No. SD-09665 and appurtenant to the move-from tracts were reserved separately and are owned by the applicant.

The applicant further proposes to transfer said FDR of 0.75 afa, inclusive of a CIR of 0.525 afa, into domestic well RG-52837, drilled to a depth of 125 feet, with an outside diameter casing of 4 inches, located at a point where X=339,646 meters, Y=3,820,541 meters, UTM (NAD83) Zn 13N, for irrigation and commercial use on 0.25 acre within 2.5021 acres of land described as a certain tract of land situate within projected Section 5, Township 3 North, Range 2 East, NMPM, Socorro County, New Mexico and being more particularly described as follows: beginning at the northeast corner of the tract herein described from whence the east one mile corner on the Socorro-Valencia County line bears N 20° 12′ 55″ W, 4867.68 feet distance; thence S 16° 35′ 00″ W, 311.77 feet; thence N 75° 25′ 00″ W, 349.31 feet; thence N 16° 35′ 00″ E, 311.77 feet; thence S 75° 25′ 00″ E, 349.31 feet, to the point of beginning. Well RG-52837 and place of use are owned by the applicant and located approximately 0.06 mile southwest of the intersection of Mescatero Street and Carson Street, west side of Carson Street, Veguita, Socorro County, New Mexico.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless the Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the State of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, District 1 Office, located at 5550 San Antonio Drive NE, Albuquerque, NM 87109-4127, on or before February 18, 2022. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
