MEETING AND
HEARING OF THE
NEW MEXICO MINING
COMMISSION

The New Mexico Mining Commission (“Commission”) will hold a regular meeting and a public hearing at 9:00 AM on Thursday, February 15, 2024 (and Friday, February 16, if necessary), in Morgan Hall of the State Land Office, 310 Old Santa Fe Trail, Santa Fe, NM 87501. Attendees cannot park in the State Land Office parking lot, but must park at the PERA lot, one block east of the State Land Office. Before the hearing, the Commission’s website will have a link to the live webcast. However, comments will not be accepted during the live webcast. During the meeting, the Commission will conduct a public hearing on Petition 23-01(“Petition”) for adjudicatory review from Stanley King received on December 19, 2023. Petition 23-01 requests the Commission to review the Mining and Minerals Division Director’s Order dated November 13, 2023, approving Modification 23-1 to Permit No. CA027EM for Summa Silver Mogollon. The Petition raises concerns regarding minimal impact mining activity proximity to animal habitats, historic sites, and watersheds, as well as a question regarding the permit area. The Petition requests the Commission to suspend Modification 23-1, re-evaluate the “minimal impact” status, and address concerns about the project boundary. At the conclusion of the hearing, the Commission may deliberate and make a final decision on the Petition. The hearing on the Petition will be conducted in accordance with all applicable provisions of the New Mexico Mining Act and Commission Rules. Adjudicatory review procedures are found in Part 14 of the Commission Rules (19.10.14.1417-19.10.14.1448 NMAC). All “interested” parties may participate in the hearing, subject to the provisions of Part 14. Procedures for persons wishing to intervene, to present public comments, and to present evidence as an interested participant are provided in 19.10.14.1424 (A), and 1434(D) NMAC, respectively. Intervenors and interested participants desiring to present evidence shall submit a written notice of intent to do so to the Commission at least 10 days prior to the hearing date to the Clerk of the Commission, c/o Mining and Minerals Division, 1220 South Saint Francis Drive, Santa Fe, NM 87505, not later than 5:00 PM, Monday, February 5, 2024, and should reference the petition number and the date of the hearing.
