NOTICE is hereby given that on January 2, 2024, Preston C. White, HC31, Box 14A, Hatch, NM 87937, and Maez Revocable Trust, c/o Leland R. Maez and Kristine M. Maez, trustees, 20 Bravo Farms Rd, La Joya, NM 87028, filed Application No. SD-08329-A into RG-A1669 with the STATE ENGINEER for Permit to Change Point of Diversion, Place, and Purpose of Use from Surface Water to Ground Water within the Rio Grande Underground Water Basin of the State of New Mexico.

Socorro County is the county affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in El Defensor Chieftain.

The applicants propose to discontinue the farm delivery requirement of 10.50 acre-feet per annum of surface water, inclusive of a consumptive irrigation requirement (cir) of 7.35 afa, from the Socorro Main Canal with a point of diversion located at the San Acacia Diversion Works (SP-1690-4) located in the SW1/4 NE1/4 NE1/4 of Section 1, Township 1 South, Range 1 West, NMPM, at a point where X=326,225 meters, and Y=3,792,219 meters, UTM (NAD83) coordinate system, Zone 13N, on land owned by the MRGCD, used for the irrigation of 3.50 ac. of land, owned by Preston C. White, described as part of Tr. 28-A on MRGCD Map 149 in Section 14, Township 1 South, Range 1 West, NMPM, in Socorro County. Said move-from land is located at the intersection of Escondida Ln. and Canal Rd. near San Acacia, NM.

The applicants further propose to transfer the subject 7.35 afa cir to proposed well no. RG-A1669, to be located within 100 ft. of the point where X=331,567 meters and Y=3,805,481 meters, UTM (NAD83) coordinate system, zone 13N, drilled to a depth of 350 ft., using 6 in. casing, for commercial, drip and sprinkler irrigation, and sustainable agriculture purposes, within 5.0 ac. of land, described as Tr. 49 on MRGCD Map 138, within projected Section 27, Township 2 North, Range 1 East, NMPM in Socorro County. The move-to place of use and location of the proposed move-to well are on land owned by Maez Revocable Trust and are located along the Lower San Juan Riverside Drain approximately 1.1 mi. southwest of the intersection of NM HWY 304 and Calle Allegre near Contreras, NM.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment, if impairment you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM, 87109, on or before April 19, 2024. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
