NOTICE OF PENDENCY OF ACTION

NOTICE IS HEREBY GIVEN that the Plaintiff in the above entitled cause, Guadalupe Pando, filed in the District Court of Socorro County, New Mexico, their Complaint To Quiet Title against the above named Defendants, together with the Affidavit of a competent person that, upon diligent inquiry, the addresses of the above Defendants, All Known and Unknown Claimants of Interest in the Subject Property, and the last known address as cannot be determined by Plaintiff; that a cause of action exists against all of the Defendants; that all of said Defendants are necessary parties to the action; and that said action is instituted and prosecuted for the purpose of quieting title as against all Defendants, claims, and claimants whomsoever and against the world to the following described real estate in said complaint, and situate in Socorro County, State of New Mexico, to-wit:

A tract of land in the W1/2 of Sec. 10 of the Socorro Grant, Socorro County, New Mexico, begin the east portion of Tract 19-d of M.R.G.C.D. Map 160-161, also being part of City Survey 400 Tr. 7, bound on the east by the A.T. & S.F. Rwy., bound on the south by the Hefner Addition to Socorro, and more particularly described as follows, to-wit:

Beginning at Corner 1, the SE corner, said corner being indentical with the NE corner of the Hefner Addition, whence the Section corner common to Sec. 9, 10, 15 and 16 of the Socorro Grant bears S. 50º05’30” W., a distance of 2852.1 ft.;

Thence, S. 82º37′ W., a distance of 766.5 ft. to Corner 2, the SW corner;

Thence, N. 9º28’30” W., a distance of 728.2 ft. to Corner 3, the NW corner;

Thence, N. 83º23′ E., a distance of 807.9 ft. to Corner 4, the NE corner, a point on the west R/W line of the A.T. & S.F. Rwy.;

Thence, S. 6º12′ E., a distance of 717.1 ft. along the west R/W line of the A.T. & S.F. Rwy., to Corner 1, the point and place of beginning.

Together with an irrigation ditch easement 15 feet in which over, along and through land now or formerly belonging to Scott Haley and Pat Haley for the purposes of conveying water and irrigation of the above conveyed land and for all other purposes reasonably necessary to Grantees’ use and enjoyment and maintenance of said irrigation ditch, which said easement is more fully described as follows:

A strip of land, 15 ft. in width bounded by the above conveyed land at its easterly end; bounded by the Florida lateral at its westerly end; and adjoining and lying to the south of the following described survey line;

Commencing at the NW corner (corner 3) of the above conveyed land;

Thence, S. 83º23′ W., a distance of 17.7 ft. to an angle point;

Thence 57º48′ W., a distance of 269.5 ft. to the end fo the line hereby described, being a point in or on the Florida lateral.

Subject to patent restrictions and reservations, easements and rights-of-way of record.

NOTICE IS FURTHER GIVEN to each and all of the said Defendants that you must answer or otherwise respond to the Complaint in writing on or before thirty (30) days after the last publication of this Notice, and if you fail to do so, a Judgment may be entered against you upon your default for the relief the Plaintiff has demanded.
