NOTICE OF PENDENCY OF ACTION

NOTICE IS HEREBY GIVEN that the Plaintiff in the above entitled cause, Joe Anne Mack, filed in the District Court of Catron County, New Mexico, their Complaint to Quiet Title against the above named Defendants, together with the Affidavit of a competent person that, upon diligent inquiry, the addresses of the above Defendants, All Known and Unknown Claimants of Interest in the Subject Property, and the last known address as cannot be determined by Plaintiff; that a cause of action exists against all of the Defendants; that all of said Defendants are necessary parties to the action; and that said action is instituted and prosecuted for the purpose of quieting title as against all Defendants, claims, and claimants whomsoever and against the world to the following described real estate in said complaint, and situate in Socorro County, State of New Mexico, to-wit:

A certain tract of land situate in Section Ten (10), Township Two (2) South, Range Three (3) West, N.M.P.M., Socorro County, New Mexico, being designated as the E1/2W1/2W1/2 of said Section Ten (10), being a portion of those certain tracts of land deeded to Lorene Gray and Mona Dennison as Trustees of the Cecil V. and Lorene Gray Revocable Trust by Cecil V. and Lorene Gray on December 5, 1995, as recorded In the Socorro County Clerk’s Office in volume 447, page 665, being also a portion of those certain tracts of land deeded to Lorene Gray and Mona Dennison as Trustees of the Cecil V. and Lorene Gray Revocable Trust by Lorene Gray, a widow, on December 17, 1996, as recorded in the Socorro County Clerk’s Office in volume 452, page 910, being bounded on the north by the section line common to Sections 3 and 10, Township 2 South, Range 3 West, N.M.P.M., bounded on the east by land now or formerly standing in the names of Steven and Michelle Kimbrell, bounded on the south by land now or formerly standing in the names of S. E. and Lucille Gutierrez, bounded on the west by land now or formerly standing in the name of Cecil V. and Lorene Gray Revocable Trust, and being more particularly described by metes and bounds as follows, to-wit: :

Beginning at comer 1, the NW comer, being a set ½ inch rebar, being the NW Comer of the E1/2W1/2W1/2 of said Section 10, whence the found 1915 brass cap monument marking the section comer common to Sections 3, 4, 9 and 10, Township 2 South, Range 3 West, N.M.P.M., bears South 89°57’30" West, a distance of 660.24 feet;

Thence, North 89°57’30" East (North 89°52′ East, record), a distance of
660.24 feet along the section line common to Sections 3 an 10, Township 2 South, Range 3 West, N.M.P.M., to comer 2, the NE comer, being a set ½ inch rebar, being also the West 1/16 corner common to Sections 3 and 10, Township 2 South, Range 3 West, N.M.P.M.;

Thence, South 0°15’45" West, a distance of 5297.31 feet to corner 3, the SE comer, being a set ½ inch rebar, being also the West 1/16 comer common to Sections 10 and 15, Township 2 South, Range 3 West, N.M.P.M..;

Thence, South 89°49’15" West (South 89°56′ West, record), a distance of
654.01 feet along the section line common to Sections 10 and 15. Township 2 South, Range 3 West, N.M.P.M.,to comer 4, the SW comer, being a set ½ inch rebar;

Thence, North 0°11’45” East, a distance of 5298.84 feet to corner 1, being the point or place of beginning.

Containing 79.923 acres, more or less.

NOTICE IS FURTHER GIVEN to each and all of the said Defendants that you must answer or otherwise respond to the Complaint in writing on or before thirty (30) days after the last publication of this Notice, and if you fail to do so, a Judgment may be entered against you upon your default for the relief the Plaintiff has demanded.
