NOTICE is hereby given that on February 7, 2024, Focus Stream International, LLC, 3190 New Brunswick Road, Bartlett, TN 38133 and co-applicant Lonnie Wade Orr, 73 Bowman Lane, Lemitar, NM 87823, filed with the STATE ENGINEER Application NoRG-7688-A for Permit to Change Purpose and Place of Use of Groundwater and add an Additional Groundwater Point of Diversion within the Middle Rio Grande Underground Basin, in the State of New Mexico.

Socorro County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the El Defensor-Chieftain.

The applicants propose to discontinue the use of a consumptive use water right consisting of 19.965 acre-feet per annum (afa) of groundwater diverted from existing, permitted well RG-7688-A located where Latitude 34° 11′ 39.13″ North and Longitude 106° 54′ 8.77″ West (WGS84) intersect, on land owned by Focus Stream International, LLC, for livestock and commercial use on 18.6 acres of land described as Pt. of Tract 12B1A2A3, MRGCD Map 151, also owned by Focus Stream International, LLC.

The applicants further propose to commence the diversion of 19.965 acre-foot consumptive use of groundwater per annum, from three (3) existing, permitted wells, well RG-7688 located at the intersection of Latitude 34º 11′ 53.57″ North and Longitude 106º 54′ 24.15″ West, on land owned by Lonnie Wade Orr, well RG-7689 located at the intersection of Latitude 34º 11′ 50.90″ North and Longitude 106º 53′ 59.0″ West (WGS84), on land owned by Lonnie Wade Orr, and RG-7688-A, as described above, for commercial, drip irrigation for cannabis production purposes on 25.20 acres of land, described as MRGCD Map 151, Tract 12B1A2A3 (12.0 acres) owned by Focus Stream International, LLC, and Tract 12B1A2A1B (13.2 acres) owned by Lonnie Wade Orr. The move-from and move-to locations are generally located at the intersection of NM 408 and Charolois Road, 1.3 miles southeast of Polvadera, Socorro County, NM.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number, email address, and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment; if impairment, you must specifically identify your water rights; and/or (2) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, 5550 San Antonio Dr., Albuquerque, NM 87109, on or before Friday, May 3, 2024. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer at (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
