NOTICE is hereby given that on September 20, 2023, applicant The Ranches, Inc., c/o Pete Domenici Jr., 320 Gold Avenue SW, Suite 100, Albuquerque, NM 87102, filed Application No. RG-682 with the STATE ENGINEER for permit to Change Place of Use, Purpose of Use, and Point of Diversion of Groundwater to Surface Water and Groundwater in the Rio Grande Water Basin of the State of New Mexico.

Socorro is the County affected by the diversion and in which the water has been or will be put to beneficial use. This notice is ordered to be published in the El Defensor-Chieftain.

The applicant proposes to discontinue the farm delivery requirement of 107.76 acre-feet per annum (afa) of groundwater, inclusive of the consumptive irrigation requirement of 75.43 afa, from well no. RG-682, located at a point where latitude = 34° 26′ 49.2" N and longitude = 106° 47′ 24.34" W, WGS84 coordinate system, used for the irrigation of 35.92 ac. of land described as parts of Tracts 8C1A1 (23.09 acres), 8C1A2A (10.10 acres), 8C1A2B (0.2 acre), 8C1B1 (0.05 acre), 8C3 (0.11 acre), 8C4 (0.12 acre), and 8C5A (0.27 acre), all on MRGCD Map 130, and part of Tract 8C1B2 (1.98 acres) located on MRGCD Map 131.

The applicant further proposes to divert the above listed consumptive portion of 75.43 afa from wells RG-682-POD3 located at a point where latitude = 34° 26′ 45.98" and longitude = 106° 47′ 24.34" and RG-682-POD4 located at a point where latitude = 34° 26′ 37.76" and longitude = 106° 46′ 47.11", all coordinates in WGS84 coordinate system, in addition to the Isleta Diversion Works (SP-1690-3) located at a point where X=346,037 meters, Y=3,863,880 meters, UTM (Zone 13) (NAD83) via the Belen Grant Lateral #1 to maintain 20.77 acres of ponds described as Pond 1 (2.98 acres) generally located at a point where latitude = 34° 26′ 32.43" and longitude = 106° 46′ 51.78", Pond 2 (7.73 acres) generally located at a point where latitude = 34° 26′ 28.21" and longitude = 106° 47′ 6.32", Pond 3 (6.61 acres) generally located at a point where latitude = 34° 26′ 14.67" and longitude = 106° 47′ 34.29", and Pond 4 (3.45 acres) generally located at a point where latitude = 34° 26′ 1.42" and longitude = 106° 47′ 23.78", all coordinates in WGS84 coordinate system.

The subject lands and points of diversion are all owned by The Ranches, Inc., and generally located 0.83 mi. southwest of La Promesa Elementary School and 2 mi. northeast of Bernardo Waterfowl Management Area.

Any person, firm or corporation or other entity asserting standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number and mailing address). If the protest does not include the complete name, phone number, email address, and mailing address, it may be deemed invalid and not accepted for filing unless Protestant provides with the protest an affidavit stating that it does not have one of the above-listed elements/requirements (phone number, mailing address, email address, etc.). The objection to the approval of the application must be based on: (1) Impairment, if impairment you must specifically identify your water rights; and/or (2) Detriment; if detriment, you must specifically identify your water rights; and/or (3) Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you shall be required to provide evidence showing how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, 5550 San Antonio Dr. NE, Albuquerque, NM, 87109, on or before February 9, 2024. Facsimiles (faxes) will be accepted as a valid protest if the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the Office of the State Engineer, (505) 383-4030. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
