NOTICE is hereby given that on December 27, 2023 and amended on February 1, 2024, co-applicants Chacon Family Trust, c/o WaterBank®, 610 Gold Ave., SW, Suite 111, Albuquerque, NM 87102 and Mac and Janis Murray c/o WaterBank®, 610 Gold Ave., SW, Suite 111, Albuquerque, NM 87102, filed with the STATE ENGINEER Application No. SD-09707-A, for a Permit to Change the Place of Use of Surface Water, within the Middle Rio Grande Water Basin, of the State of New Mexico.

Socorro County is the County affected by the diversion and in which the water has been or will be put to beneficial use. This Notice is ordered to be published in the El Defensor Chieftain (Socorro County).

The co-applicants propose to discontinue the diversion of 14.790 acre-feet per annum (afa) Farm Delivery Requirement (FDR) of surface water, inclusive of a Consumptive Irrigation Requirement (CIR) of 10.353 afa, for the irrigation of 4.93 acres of land, owned by Martin T. Black, described as Tract 21A (1.47 acres), Tract 21E (0.74 acre) and Tract 21C2A (2.72acres), located on MRGCD Map No. 122, irrigated from the San Juan Ditch, with a point of diversion on the Rio Grande at the Isleta Diversion Dam (SP-1690-3), on land owned by the Pueblo of Isleta, located within the Pueblo of Isleta Grant, within projected NE¼ NE¼ SW¼ of Section 24, Township 8 North, Range 2 East, NMPM, within Valencia County, at a point where X=346,037 meters and Y=3,863,880 meters intersect, UTM Zone 13N, NAD 1983. The move-from tracts are generally located south of Ranchitos Rd., east of the San Juan Acequia and west of the Las Nutrias Interior Drain, Veguita, Socorro County, New Mexico. The subject surface-water rights are owned separately by the Chacon Family Trust. The transfer distance to the move to location is about 0.65 miles from the move-from location.

The co-applicants further propose to transfer the 14.790 afa FDR of surface-water rights, inclusive of a CIR amount of 10.353 afa, for the irrigation of 4.93 acres total, owned by Mac and Janis Murray, described as Tract 79 (4.0381 acres) and the North Portion of Tract 1 (0.8919 ac.), Lands of Dale and Jennifer Jaramillo, located on MRGCD Map No. 120, irrigated from the San Juan Ditch, with the same point of diversion on the Rio Grande being the Isleta Diversion Dam (SP-1690-3). The move-to tracts are generally located on the east side of Jaramillo Loop, east of the intersection – of Veguita Farms Loop and the San Juan Main Canal, Veguita, Socorro County, NM. The surface-water rights appurtenant to Tract 79 were severed under Permit No. SD-02787 & SD-3437 into RG-960, approved on August 7, 1996. The surface-water rights appurtenant to Tract 1 were severed under Permit No. SD-04811 into RG-960, and said water rights were temporarily leased back to Tract 1, under Temporary Lease Permit No. (RG-960 into SD-04811)-T. Both permits were approved on May 17, 2002. The temporary lease back permit expired on May 17, 2007.

This application was filed with a request for Emergency Authorization under 72-5-25 NMSA 1978.
